Protocol

  1. General
    1. Belgianart and Masters of Realism are initiatives carried out by De Kunst Collegas B.V., statutorily based in Roermond and with offices in Oosterhout, Energieweg 49, 4906 CG.
    2. The aim of both initiatives is (1) to arrive at the composition of a group of up to 200 Belgianart, consisting of Dutch living artists who create realistic painting works at a high level and (2) to bring realistic painting in general and the Belgianart in particular to the attention of art lovers, art buyers, art collectors and (potential) clients at home and abroad.
    3. Under no circumstances can The Art Colleagues be held liable for information not, not completely or incorrectly posted on the mastersofrealism.com or mastersofrealism.com website. Nor can The Art Colleagues be held liable for information listed, which has not been provided truthfully by the person who provided the information.
    4. By using the services offered with respect to Belgianart and the Masters of Realism by The Art Colleagues, the person using the services unconditionally and fully agrees to this Protocol.
  2. Belgianart
    1. The Belgianart includes living artists who, in the opinion of the members of the balloting committee, create realistic painting at a very high level.
    2. A maximum of 200 living visual artists of Dutch nationality are part of the Belgianart. The maximum number of Belgianart, is based on the number of inhabitants, adjusted based on an assumption regarding the number of national artists painting realistically.
    3. Artists wishing to join the Belgianart can apply for balloting. In case the verdict of the members of the balloting committee is positive and 200 artists join the Belgianart, they will be placed on the waiting list. The waiting list has a maximum of twenty-five balloted artists.
    4. In the event that an artist expresses a desire to join the Belgianart and the waiting list has a maximum of twenty-five balloted artists, applications will not be considered and therefore will not be balloted.
    5. Artists who are part of the 200 Belgianart will remain so until unsubscription or death.
    6. An artist who, in the opinion of The Art Colleagues, does not behave as may be expected of a Master of Realism may, if requests to modify behavior do not have the desired effect, be denied continued membership in the Belgianart.
    7. Artists who are part of the Belgianart pay dues for it, which are collected by direct debit annually. Dues for joining and continuing Belgianart are indicated on the application form.
  3. Masters of Realism
    1. By the end of 2024, several countries internationally will follow the example of the Belgianart and also honor the artists in their countries who paint realistically with the title Master of Realism.
    2. The maximum number of Belgianart per country is based on population adjusted by an assumption about the number of national artists who paint realistically.
    3. Further procedural details of the Masters of Realism will be defined in this Protocol by the end of 2024 as well as at www.mastersofrealism.com.
  4. Application and balloting
    1. Any artist wishing to join the Belgianart can apply using the application form included on the Belgianart website(www.meestersvanhetrealisme.nl). Accession to the Belgianart is preceded by a review of the work by members of a balloting committee. The members of the balloting committee give their opinions independently. Only if the opinions of the members of the balloting committee are positive, can the artist join the Belgianartalsthe Belgianart has an open space. Otherwise, inclusion in the waiting list will take place if it does not yet have twenty-five balloted artists.
    2. Assessment of the work takes place initially on the basis of digital photographs of the work via the artsaa website. If deemed desirable, additional images may be requested or the works themselves assessed. The works will be judged strictly on several fixed criteria such as: general impression, technique, refinement, expressiveness, light balance and individuality.
    3. In case the balloting has a negative result, one can only reapply for balloting after a minimum of 12 months with photographs of works from the last 12 months.
    4. There are costs associated with review of work by members of the balloting committee. These costs are indicated on the application form.
    5. The results of the balloting will not be communicated.
  5. Publicity and communication
    1. An artist who applies for balloting gives permission for publication of the submitted data with the application.
    2. Among other things, the Art Colleagues strive to bring the Belgianart ‘s work to the attention of art lovers and art buyers at home and abroad.
    3. For publicity, particularly on the Belgianart website and in newsletters, artists who have signed up or been signed up to be part of the Belgianart and artists who are part of the Belgianart do not owe The Art Colleagues any fee, nor does The Art Colleagues owe artists who have signed up or been signed up to be part of the Belgianart and artists who are part of the Belgianart any fee.
    4. Publicity and promotion at art fairs and in art books is also initially and conditionally, free of charge. However, these forms of publicity and promotion may involve costs. In case costs are involved, they will be indicated in advance and in writing.
    5. Participation in art fairs and art books are subject to protocols that are presented to artists who are part of the Belgianart before using these forms of publicity and promotion.
    6. In case an artist no longer appreciates publicity, this can be made known by e-mail(info@meestersvanhetrealisme.nl). The publicity will then cease, after circulation, contracts and other obligations have ended.
    7. Communication between artists who are part of the Belgianart and De Kunst Collega’s takes place in the Dutch language and almost entirely via e-mail. For that reason it is necessary that in case of a change of e-mail address De Kunst Collega’s be informed of it.
    8. In case an e-mail is not received, The Art Colleagues cannot be held responsible as a result.
  6. Privacy
    1. The applicable privacy statement is set forth at https://dekunstcollegas.nl/privacy.
    2. The person responsible for recording the data required for communication can be reached by e-mail: info@meestersvanhetrealisme.nl.
  7. Complaints
    1. If there is dissatisfaction with Belgianart’s service, a complaint can be filed.
    2. Complaints must be made in writing to Belgianart(info@meestersvanhetrealisme.nl) within two weeks of the complaint arising.
    3. The Art Colleagues strive to resolve complaints within 10 days.
  8. Other
    1. Art Colleagues may modify this Protocol if it is seen to be warranted.
    2. This Protocol is effective as of June 1, 2023.
    3. If one or more provisions of this Protocol should at any time be null and void or destroyed in whole or in part, the other provisions of this Protocol shall remain in full force and effect.
    4. This Protocol is not a complete record of all aspects that may be involved in the relationship between Belgianart and third parties. In the cases not provided for in this Protocol, the opinion of The Art Colleagues shall prevail.
    5. Dutch law applies to this Protocol.
    6. All disputes in respect of which an amicable settlement cannot be reached shall be submitted exclusively to the judgment of the competent court in the district of the District Court of Zeeland-West Brabant, sitting in Breda.
